GOOD MORNING
Just a starter, nothing to say , I did wake up alive and fairly well this morning in Brazoria County Texas. Weather is nice, slight breeze, just at daybreak and my girlfriends new pond in the back has attracted most of Brazoria County's small birds and squirrels.
I wish I was of the mond of Leon Hale and could detail what I actually see and what it feels like to see what she has done, and the effect it has on sobering my many times raging attitude. Maybe a second and larger pond will dull that raging bull attitude even more..
Just read the blog about the "babysitting while white".. I don't know the answer. Surely no crime, the crime is that it ruined my waning rage , it returned as I placed myself in the mans (and the poor childs) footsteps, I do not know what I might have done.
Deepening resentment of our country;s dwindling privacy and freedoms (still the greatest nation in the world) election of unknown quality Presidents, criminal charges now standing where the defendant must prove innocence..
No, I did not vote for Obama, not because of race, not because of political stance, but because there is nothing known about him. I also had a hard time considering voting for the name.Apparent reasoning I hope.
It is no crime to walk a black child or any child. The officers had to follow up on there 911 call and I am not sure what to be done. A known though , it did not require several patrol units and it did not require testosterone injection to resolve, lol, but somewhere in my 35 years as a Texas Officer I am sure i injected mine.
I feel deeply for the detained man and know excatly what I would have wanted to do.
In my 35 years of overt Texas enforcement I worked many homicides and other major crimes. One significant homicide was near the city of Manvel in Brazoria County. Not long ago I took my girlfriend there and showed here the site where a young girl or unknown identity was found skeletonized. i knwo the killer but the case is unresolved. My girlfriend has a crime blog called officialcoldcaseinvestigations.com, she has deep interest.
The site of this find was off SHW 288, 50 yards off the roadway on a little used county road, clearly visible from the major 288 highway, a major artery flowing into the place called Houston.
As I pointed out the spot a Manvel PD cruiser arrived. The officer recognized me and asked what we were doing, I explained. Depsite knowing me , the officer in the baseball cap asked us to produce identification which I reluctantly did, letting my displeasure be well known.
Baseball cap went to his unit and checked us for wanted and records. I was amazed, confused and angry. I asked why and was told that we were in an area of frequent homicide dumping and showed interest in a homicide and knew where the body had been.
I worked the case in 1992. 16 years earlier and had a reason to know where the body was found.
The officer released us from detention smirking. An unbelievable thing to me.
The event confounded and angered me. I asked the Police Chief why this occurred and I recieved a copied and pasted reply citing a case decision on stop and arrest. It was entitled preliminary acts leading to arrest. The elements quoted by the Chief quite clearly said we were about to have been arrested being suspicious persons in suspicious place. This too my rage answered and asked of the Chief "for what?". He blocked my email.
Most of my law enforcement tenure was in the District Attorneys office, in the courtroom, acting as investigator, paralegal and prosecution support. I at least ran across law from time to time, and despite the rule being that interpretation of law is allowed to licensed attorneys only, I allowed myself the luxury of having an opinion on the law.
3 times my youngest son has come home charged with minor in possession, more times with friends charged with minor in possession of tobacco.
5 hot beer cans-full, in fathers car, in ice chest with no ice, in trunk, daughter driving, 5 vehicle occupants, all 5 charged with minor in possession of alcohol.
3 cases child of man driving mans car, mans CHEWING TOBACCO in the front area of the car, daughter , all 95 pounds of a 15 year old, charged minor in possession of chewing tobacco.
One 21 year old driving relatives car after he had a flat, in same city, Angleton, stopped for speeding, agreed to search of the car, had been operating the car belonging and registrered to the relative for about 5-10 minutes. Charge-possession of controlled substance, a single cap of hydrocodone prescribed to the relative for pain, found under the passenger seat where the relative had spilled he contents of the bottle 2 weeks prior and failed to locate this one.Conviction or no conviction, Homeland Security will raise eyebrows on this one as well as future potential employers.
What do we do? Me? Well I took retirement, once retired it seems you never were to begin with, 6 month street cops scoff at any expressed knowledge on the subjects of good police practice.
The man with the black child? I guess he is like me, he can only sit and recall what happened and fume alone in frustration and wonder what would have happened if he had been in a scenario that had caused one more suspicious element of his already "suspicious" actions. Guess he should be very glad he was not seen checking underpants for dirtiness, he would have been in serious trouble then,
